What You Should Know About Social Security Benefits
Many believe wrongly that filing for Social Security is a simple process. In reality, it is a confusing, long process governed by strict government regulations as the statistics show. These same statistics demonstrate that the key to maximizing your ability to secure the benefits you need is dependent upon properly supporting your claim from the outset. If you are unable to work due to a disability, there are some things you should know about your Social Security rights:
- Social Security Disability Insurance (SSDI) exist to help people who are unable to earn sufficient income.
- If you have been hurt in a workplace accident, you may be eligible for
both workers' compensation and Social Security disability.
- Having your disability claim denied is not the end of the process. You still have options available to help you get the benefits you need and hiring an attorney may be the best option.
- If you also have a long term disability claim, don't let the insurance company dictate who represents you in your Social Security claim. These "advocates" or "representatives" work for the insurance company and are usually not lawyers who are ethically bound to protect only your interests.
- Get regular medical treatment and regularly request copies of chart notes from these visits.
- Never miss deadlines for anything involving social security disability.
- Never trust the social security office for anything (they lose things ALL the time) - meaning you should always get information verified and always double check, even when it comes to things you have mailed to the office.
- If you have filed an initial application without an attorney, regularly check the status of your case by calling disability determination services (where your case is actually processed--in other words, call DDS, not the social security office), or contact Minnesota Disability.
- Have a frank conversation with your treating doctor. Ask him directly if he is willing to support your disability claim in writing. Without the proper medical evidence, no social security attorney can win your claim.
- Contact Minnesota Disability IMMEDIATELY and never wait to do so until the end of the 60-day deadline. Often your initial application lacked medical support for your claim that we can assist in obtaining for you.
- Always appeal if you
are denied following an initial application. At Minnesota Disability our
